By submitting your story to Ko Awatea (acting under CMDHB) (hereinafter referred to as “Ko Awatea” for the purposes of The Medicine Stories Project) for publication, you accept and agree to the following Terms and Conditions:
- You accept that once you have submitted your story, it will be stored by Ko Awatea and held in accordance with the Public Records Act 2005. This applies even if Ko Awatea decides not to publish your story.
- You accept that Ko Awatea may decide that it will not publish and may not give you a reason for its decision. Publication decisions are made at Ko Awatea’s sole discretion.
- You agree that you will not receive any payment from Ko Awatea for the use and publication of your story but, if your story is published by Ko Awatea, Ko Awatea will provide you with a free PDF of the final edited version of your story.
- Ko Awatea will acknowledge you as the author(s) of the story.
- You grant Ko Awatea a non-exclusive right to copy, modify and also publish your story on The Medicines Stories Project website, and other Ko Awatea/CMDHB websites and/or hard copy publications, for the full legal term of copyright.
- You warrant that you have all the rights, authorisations, permissions and licenses necessary to submit this story to Ko Awatea and grant the rights listed in these Terms and Conditions to Ko Awatea.
- You warrant that Ko Awatea’s use and publication of your story (including any artwork, graphics photographs or similar works that may be contained in your story) will not infringe the intellectual property rights of any third party.
- You warrant that Ko Awatea’s use and publication of your story will not invade the privacy interests of any person.
- You warrant that your story does not contain any unlawful statements and that Ko Awatea’s use and publication of your story will not infringe, violate or conflict with the rights or interests of any third parties.
- You agree to indemnify Ko Awatea against any and all claims, damages, penalties, losses and costs (whether direct, indirect or consequential and including legal fees) which
Ko Awatea/CMDHB incurs in connection with a claim that Ko Awatea’s use or publication of your story infringes the rights, interests or privacy of a third party. - If your story was prepared jointly with other authors, you warrant that you are confirming acceptance of these Terms and Conditions as an agent for those joint authors and have been authorised by them to do so.
